Impact Fitness Coaching Academy · Effective Date: 4/1/2020
Impact Fitness Coaching Academy (“Company,” “we,” “us,” or “our”) respects your privacy and takes the responsibility of protecting the Personal Information that you provide to us via the Services (defined below) seriously. We encourage you to review this Privacy Policy carefully so that you have a clear understanding of our privacy practices. If you do not agree with our policies and practices, do not access, continue to access, or use the Services.
This Privacy Policy is intended to outline our practices regarding the collection, use, disclosure, and protection of information received from users of the Services, including users in the European Economic Area (“EEA”) and residents of the State of California (collectively, “you” or “user”). We adopt this Privacy Policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and the EU General Data Protection Regulation (“GDPR”).
For the purposes of compliance with the GDPR, we are the “Controller” of Personal Data (i.e., “Personal Information”) that we receive from you, if any. For the purposes of this Privacy Policy, as set forth in the GDPR, an identified or identifiable natural person in the EEA accessing the Services will be referred to as a “Data Subject.”
The Privacy Policy applies to the “Services,” which include our website (www.impactfitnesscoachingacademy.com), its subdomains, and all of the websites and internet properties owned or operated by us, regardless of the medium in which the Services are accessed by a user (e.g., via a web or mobile browser), as well as our other in-person activities, services, features, or resources.
We collect several types of information from and about users of the Services.
Personal Information: We may collect Personal Information from you in order to provide you with the information or services you may request. “Personal Information” refers to information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or device. When you complete forms on, navigate, and/or use the Services, we may collect Personal Information about you.
The categories and types of Personal Information we may collect, along with the purposes for which we use it and the third parties we share it with, include:
Personal Information does not include: information that is publicly available from government records; deidentified, anonymized, or aggregated information; or certain personal information protected by other sector-specific federal or state statutes. Where required by applicable law, we may treat certain other information as Personal Information and will comply with all applicable data protection laws.
Deidentified Information: We may collect “Deidentified Information” when you use and navigate the Services — information that cannot reasonably identify, relate to, describe, be associated with, or be linked to a particular individual (for example, information about your device, browser type, operating system, or internet service provider). As required by applicable law, we take reasonable measures to ensure Deidentified Information does not personally identify you and cannot later be easily used to do so.
Persons Under the Age of 18: The Services are not intended for persons under 18 years of age. We do not market to and do not knowingly collect, disclose, or sell any Personal Information from or about persons under 18. If we discover we have inadvertently collected such information, we will promptly take reasonable measures to delete it.
We collect Personal Information and Deidentified Information (collectively, “Your Information”) directly from you (for example, when you voluntarily complete forms) and indirectly from you when you interact with the Services (such as browsing history, search history, and interaction data your browser transmits) through automated tracking technology such as cookies and web beacons.
A cookie is a small data file transferred to a web browser that enables the Services to remember and customize your subsequent visits. You can instruct your browser to block cookies or warn you before accepting them; if you reject cookies, some features of the Services may be limited. We may also use web beacons — single-pixel electronic images embedded in the Services — to gather information about your browsing activities. We will not collect additional categories of Personal Information without providing you notice.
We use Your Information for various business purposes, including but not limited to: delivery of Services (e.g., transactional emails and updates); customer service and user communications; user-experience personalization (analyzing usage patterns to optimize your experience); direct marketing (you may opt out at any time); and business optimization. We will not use the Personal Information we collect for materially different, unrelated, or incompatible purposes without providing you notice.
We may share and disclose Your Information to third parties for a business purpose or to fulfill legal obligations. When we disclose Personal Information for a business purpose, we enter into a contract requiring the recipient to keep it confidential and to use it only to perform the contract. Circumstances include:
We may disclose the following categories of Personal Information for a business purpose: Identifiers; California Customer Records categories; and Internet or similar network activity.
We do not sell Personal Information to any third parties.
Under certain circumstances, Data Subjects from the EEA may have rights under the GDPR, including the rights to: access the Personal Information we maintain about you; be informed about how we process it; correct it; have it erased; object to or restrict processing; and request that it be transferred to a third party. To exercise these rights, contact us using the details below; we will process your request within a reasonable period. The GDPR may limit the exercise of these rights in certain circumstances.
Withdrawing Consent. You may withdraw consent for processing your Personal Information at any time by contacting us below. Withdrawal may limit our ability to deliver Services and does not affect the lawfulness of processing based on consent given before withdrawal. Even after withdrawal, we may process your Personal Information where required by law.
Filing a Complaint. EEA Data Subjects may file a complaint with EU data protection authorities. A list of DPAs from the European Commission is available at ec.europa.eu.
Under the CCPA, California residents may have the right to: request disclosure of certain information about our data-processing practices over the past 12 months; receive requested information in a portable, readily usable format (data portability); request deletion of Personal Information we collected and retained, subject to exceptions; and be free from discrimination for exercising these rights. The CCPA may limit these rights in certain circumstances.
Verifiable Consumer Requests. To exercise the rights described above, submit a verifiable consumer request by visiting www.impactfitnesscoachingacademy.com or emailing [email protected]. Only you, or someone legally authorized to act on your behalf, may make a request, and only twice within a 12-month period for access or portability. Your request must provide enough information for us to verify your identity and describe your request with enough detail for us to evaluate and respond. We cannot respond if we cannot verify your identity or authority. Making a request does not require you to create an account, and we will only use information provided to verify your identity.
Response Timing and Format. We endeavor to respond within 45 days of receipt; if we require more time we may take up to an additional 45 days and will explain the reason in writing. Disclosures cover the 12-month period preceding receipt of the request. If we cannot comply, our response will explain why.
Once we receive and confirm a verifiable consumer request, we will disclose the categories of Personal Information collected; the categories of sources; the business or commercial purpose for collecting it; the categories of third parties with whom we shared it; and the specific pieces of Personal Information collected. For portability requests we provide the information in a readily usable format. For deletion requests, unless an exception applies, we will delete (and direct our service providers to delete) the Personal Information. We do not charge a fee to process a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded, in which case we will provide an explanation and cost estimate first.
For EEA Data Subjects, we may transfer your Personal Information outside the EEA for processing consistent with the purposes above. By providing Personal Information, you understand and agree it may be transferred across national boundaries and processed outside the EEA, including by trusted third parties.
We will only retain your Personal Information for as long as necessary to fulfil the purposes for which we collected it, including satisfying any legal, accounting, or reporting requirements.
California’s “Shine the Light” law permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct-marketing purposes. To make such a request, contact us using the details below.
The Services use commercially reasonable security measures to protect your Personal Information. However, no data transmitted over or accessible through the internet can be guaranteed to be 100% secure. While we attempt to protect your Personal Information, we cannot ensure or warrant that it will be completely secure from misappropriation or from failures of hardware, software, or telecommunications networks.
We do not participate in bulk email solicitations you have not consented to receive. We do not sell or disclose customer lists or email-address lists to unrelated third parties, and except as provided herein we do not share Personal Information with third-party advertisers.
This Privacy Policy was last reviewed and modified as of the Effective Date above. We may update it at any time in our sole discretion. It is your responsibility to review this Privacy Policy for changes each time you use the Services.
The Services may contain links to other websites. We do not endorse or make any representations or warranties concerning, and will not be liable for, any content, products, services, software, or materials available on external websites, even if framed within the Services. We are not responsible for the privacy practices or policies of other websites.
If you wish to access, delete, update, change, or modify your Personal Information, contact us using the details below. We will make commercially reasonable efforts to handle such requests, including modifications to direct-marketing communications, within 30 days.
To opt out of direct-marketing communications, follow the instructions in the communication or contact us using the details below.
